Terms of Service

By accessing or using the AnchorPoint Logics Electronic Visit and Care Verification Platform, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms govern all users including agency administrators, caregivers, family members, and authorized surveyors.

Acceptance of Terms

By accessing or using the AnchorPoint Logics Electronic Visit and Care Verification Platform you agree to be bound by these Terms of Service and all applicable laws and regulations. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.

Platform Description

AnchorPoint Logics provides electronic visit verification technology for Medicaid home care agencies, including:

  • NFC anchor-based visit verification at patient homes
  • Biometric identity authentication for caregivers
  • Cryptographic visit token generation for audit-proof records
  • Agency compliance dashboards and QA reporting
  • Caregiver training portal and certification tracking
  • Family care update portal with access-code authentication

Authorized Use

The platform is licensed to and may be accessed only by:

  • Enrolled home care agencies with active agreements
  • Authorized caregivers of enrolled agencies
  • Authorized agency administrators
  • Designated regulatory surveyors
  • Patient family members with valid access codes
Unauthorized access is strictly prohibited. All access attempts are logged and monitored. Unauthorized access may result in civil and criminal penalties.

Agency Responsibilities

Enrolled agencies agree to:

  • Obtain explicit caregiver consent for biometric data collection
  • Obtain patient or authorized representative consent before enrollment
  • Maintain accurate and current caregiver rosters
  • Report anchor tampering or damage immediately to AnchorPoint Logics
  • Not attempt to circumvent or disable any verification mechanism
  • Comply with all applicable Medicaid rules and EVV requirements

Prohibited Actions

Users may not:

  • Attempt to spoof GPS location or geofence coordinates
  • Use mock location applications or emulators
  • Share login credentials with unauthorized individuals
  • Tamper with, remove, or damage NFC anchor devices
  • Attempt to falsify or manipulate visit records
  • Reverse engineer, decompile, or disassemble the platform
Violations may result in: immediate account termination · report to MassHealth Program Integrity · report to HHS Office of Inspector General · civil and criminal referral

Intellectual Property

The AnchorPoint Logics platform and its underlying technology are protected by:

No part of the AnchorPoint Logics platform, including its technology, design, or documentation, may be reproduced, distributed, or used without express written permission from AnchorPoint Logics LLC.

Limitation of Liability

AnchorPoint Logics provides electronic visit verification technology only. We are not responsible for clinical care decisions, patient outcomes, or agency billing practices.

AnchorPoint Logics LLC's liability is limited to the fees paid by the agency in the three months preceding the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages.

Termination

Either party may terminate the agreement with 30 days written notice. Upon termination:

  • A full data export will be provided within 30 days
  • All platform access will be revoked immediately
  • All PHI will be deleted per our retention schedule
  • NFC anchor devices must be returned or disposed of per instructions

AnchorPoint Logics reserves the right to terminate immediately for violations of Section 5 (Prohibited Actions) without notice.

Governing Law

These Terms of Service are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Essex County, Massachusetts, or through binding arbitration as mutually agreed.
